Cancellation and Refund Policy

Foodologists Pty (Ltd) ("Foodologists," "we," "us," or "our") is committed to delivering high-quality, accessible digital training solutions for food safety professionals in South Africa. Our courses are provided entirely online and are designed for immediate access upon purchase. This policy outlines our approach to cancellations and refunds, in compliance with the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") and the Consumer Protection Act 68 of 2008 ("CPA"). By purchasing and accessing our courses, you acknowledge and agree to the terms of this policy.

1Cancellations

No Cancellations Permitted After Purchase

Due to the digital nature of our services, all courses are delivered electronically and become immediately accessible upon completion of payment. This immediate delivery constitutes the commencement of the service under Section 44 (1) of the ECTA, with your consent implied by proceeding with the purchase.

As a result, cancellations are not available once payment has been processed and access has been granted. If you have not yet completed payment, you may contact us at [email protected] prior to finalizing the transaction to discuss your options.

2Refunds

No Refunds for Digital Content Once Accessed

Our courses consist of downloadable or streamable digital materials (e.g. videos, modules, and resources), which are non-returnable and non-refundable once accessed or downloaded. This aligns with the exceptions under Section 44 of the ECTA for services that have commenced with the consumer's consent and for unsealed digital content such as software or recordings.

Limited Exceptions

Refunds may be considered at our sole discretion in the following circumstances, provided you notify us within 48 hours of purchase via email at [email protected]:

  • Non-Delivery Due to Technical Fault: If you are unable to access the course due to a verifiable error on our end (e.g. platform outage), we will either resolve the issue promptly or issue a full refund.
  • Defective Content: If the course content is materially defective (e.g. corrupted files or significant inaccuracies) and cannot be remedied, we will provide replacement access or, at our discretion, a full refund.

Any approved refund will be processed within 30 days of our written confirmation, using the original payment method, minus any applicable transaction fees. Partial refunds will not be issued for partially completed courses.

No Refunds for Change of Mind or Incomplete Use

We do not offer refunds based on a change of heart, dissatisfaction with course content (unless defective as noted above), or failure to complete the training. All sales of digital products are final upon access.

3Your Rights Under South African Law

This policy does not limit your statutory rights under the CPA, including remedies for goods or services that fail to meet implied warranties of quality (Section 56 of the CPA). If you believe the course does not comply, contact us immediately for resolution.
